solidariteitBDLive reports that trade union Solidarity said on Thursday it had won a court battle in its continuing fight over inflexible employment equity plans.  

The Labour Court on Tuesday ruled that the City of Tshwane had unfairly discriminated against one of its members by denying him a promotion.  The court found the municipality to have been inflexible when it repeatedly overlooked water audit officer Jan Pretorius for promotion and ruled that he had been unfairly discriminated against purely on the basis of race and gender.  This meant the municipality’s policy was inconsistent with the Equity Act, and had amounted to a quota system, the union said.  The battle is just one of several the union has waged over inflexible employment equity plans, notably at the SA Police Service (SAPS) and Department of Correctional Services, where a key issue is how national demographics are used within planning.
