The New Age reports that a Bill that, if passed, will protect the public from shoddy garnishee orders was formally tabled in Parliament on Friday.
The Courts of Law Amendment Bill seeks to amend the Magistrate’s Courts Act in order to address abuses in the emoluments attachment order (EAO) system, the Justice Department said. Last year, the existing garnishee order system, which allows debt collectors to obtain an order against a debtor from any court, regardless of jurisdiction and without the debtor’s knowledge, was declared unlawful. The amendment bill, which has yet to be released for public comment, provides that debtors should be present and given an opportunity to make submissions before a garnishee order is granted against them.
