TMG Digital reports that a full bench of the High Court in Johannesburg is on Friday expected to rule on whether silicosis sufferers may institute a class action against South Africa’s gold mining companies.
In October last year‚ the court heard an application by more than 50 former mineworkers who wanted to certify a class action lawsuit against 32 gold companies that owned or operated 82 mines from 1965 to the present. There is no known cure for silicosis, which can be contracted through inhaling minute particles of silica dust from gold-bearing rocks underground over a prolonged period. If certification is granted, it could lead to the largest class action lawsuit in SA’s history. If not‚ individuals would have to bring their claims in an individual capacity‚ a highly expensive task given the high cost of litigation.
