BDLive reports that the Supreme Court of Appeal has handed down a scathing judgment against the former commissioner of the Compensation Fund (CF), Shadrack Mkhonto, for flouting a settlement order to pay claims handler CompSol.
He is the latest in a growing list of state officials rebuked for ignoring court orders. Mkhonto was found to be in contempt of court and sentenced to three months in prison, suspended for five years. The CF deals with compensation claims for all work-related injuries, except lung diseases contracted on the mines. It is overseen by the Department of Labour, and despite its deep cash reserves has been in disarray for years. CompSol submits claims to the Compensation Fund on behalf of doctors who treat injured workers and had obtained a high court order in July 2009, in which the then commissioner agreed to pay out validated claims within 75 days, and process a backlog of claims that had yet to be assessed. But, Mkhonto repeatedly breached this settlement order and flouted the lower court’s directive.
