In an appeal brought by the SA Transport and Allied Workers’ Union, the Constitutional Court today upheld a law which makes organisers of gatherings liable for damages caused by the gathering unless they took all reasonable steps to avoid the damage and they did not reasonably foresee that damage. The case relates to a march in Cape Town organised by the union in 2006 during which damage to property was caused by the protestors.
